These Terms & Conditions ("Terms") govern your access to and use of the website thekindkitchennco.com (the "Site") and any products purchased from it. The Site is operated by DRIFTWOOD BOOKS LLC, trading as The Kind Kitchen Co ("we", "us", "our"). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. Products

We sell digital cookbooks, printables and bundles ("Products") delivered electronically. All Products are digital downloads. No physical goods are shipped. Products are provided DRM-free and may be read on any compatible device.

We make every effort to describe our Products accurately, but we do not warrant that descriptions or other content are complete or error-free. Product images are for illustration.

3. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By purchasing, you confirm that you meet this requirement and that the payment information you provide is valid and belongs to you.

4. Orders and Pricing

All prices are listed in US dollars (USD) and are exclusive of any applicable taxes unless stated otherwise. We reserve the right to correct pricing errors, and to refuse or cancel any order at our discretion, including where we suspect fraud or unauthorised payment.

Placing an order constitutes an offer to purchase. A binding contract is formed only when we send you an order confirmation and delivery link.

5. Delivery of Digital Products

After a successful payment, a download link is sent to the email address provided at checkout. It is your responsibility to enter a valid email address and to check your spam or junk folder. If you do not receive your link within a reasonable time, contact us at info@thekindkitchennco.com and we will resend it.

6. VIP Membership (Recurring Subscription)

The VIP Club is a recurring subscription billed at $42.95 every 30 days until cancelled. By subscribing, you expressly authorise us and our payment processor to charge your payment method $42.95 on a recurring 30-day cycle.

• First charge is taken on the day you subscribe; subsequent charges are taken every 30 days thereafter.
• This is a subscription, not a one-time purchase.
• Membership grants 50% off every Product in the store, including new releases, and access to the members-only VIP Collection.
• You may cancel at any time. Cancellation stops future charges; it does not refund a charge already taken. You keep member access until the end of the period you have already paid for.
• To cancel, use our cancellation form. We process cancellations before your next billing date and confirm by email within 24 hours.

We may change membership pricing or benefits on prior notice by email. Continued membership after the change takes effect constitutes acceptance of the new terms.

7. Refunds

Because our Products are digital and delivered immediately, all sales are subject to our Refund Policy, which forms part of these Terms. Please review it before purchasing.

8. Licence and Acceptable Use

When you buy a Product, we grant you a non-exclusive, non-transferable licence to use it for your own personal, non-commercial use. You may print a copy for personal use.

You may not resell, redistribute, sublicense, publish, or share the Products, in whole or in part, whether for profit or not, without our prior written permission. All intellectual property in the Products and the Site remains ours or our licensors'.

9. Payment

We accept Visa, Mastercard, American Express, Discover and Google Pay. Payments are processed securely by our third-party payment providers. We do not store your full card details. By submitting payment information, you represent that you are authorised to use the payment method.

10. Chargebacks and Disputes

If you believe a charge is incorrect, please contact us first at info@thekindkitchennco.com so we can resolve it quickly. Filing a chargeback without contacting us may result in suspension of access to purchased Products and to your account.

11. Disclaimers

Our cookbooks and guides, including those addressing low-sodium, kidney-friendly, diabetic or other dietary topics, are provided for general informational purposes only and are not medical or nutritional advice. They are not a substitute for professional guidance. Always consult a qualified healthcare provider before making changes to your diet, particularly if you have a medical condition. We are not liable for any outcome arising from reliance on our Products.

The Site and Products are provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law.

12. Limitation of Liability

To the maximum extent permitted by law, DRIFTWOOD BOOKS LLC shall not be liable for any indirect, incidental, special or consequential damages arising from your use of the Site or Products. Our total liability for any claim shall not exceed the amount you paid for the Product giving rise to the claim.

13. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect and use your data.

14. Changes to These Terms

We may update these Terms from time to time. The version posted on the Site at the time of your purchase applies to that purchase. Changes take effect when posted.

15. Governing Law

These Terms are governed by the laws of the State of Illinois, United States, without regard to conflict-of-law principles. Any dispute shall be subject to the exclusive jurisdiction of the courts located in Illinois.
